NOTICE OF APPLICATION AND INTENT TO ISSUE A MITIGATED DETERMINATION OF
NON-SIGNIFICANCE
The City of Ferndale has received application(s) from the applicant referenced below for a proposed development project within the city limits. Based on review of the materials submitted, the development applications have been determined to be complete. The City has received and reviewed a SEPA checklist for probable adverse environmental impacts associated with the proposed project and expects to issue a Mitigated Determination of Non-Significance (MDNS) for this project.
Pursuant to Title14 of the Ferndale Municipal Code the following notice is provided to inform the community of the City’s receipt of the development applications. The public and affected agencies are invited to comment on the environmental impacts of the proposed project and receive copies of the subsequent Threshold Determination (the MDNS), if requested. This may be the only opportunity to comment on the environmental impacts of the proposal.

PROJECT LOCATION: Intersection of Main Street and Labounty Drive, and including the Labounty Drive right of way to Nordic Way. Project site is approximately 750 feet west of the southbound ramp terminals associated with Interstate Five Exit 262, and 1,000 feet west of the Interstate Five main line. The site is east of Downtown Ferndale and within the Planned Action area of the City of Ferndale.
PROJECT DESCRIPTION: The City of Ferndale proposes the construction of a two-lane, five-leg roundabout at the intersection of Main Street and LaBounty Drive. The project will include direct “slip lanes” between Main Street and LaBounty (within the southwest portion of the roundabout), as well as between LaBounty and Main Street (within the southeast portion of the roundabout). Please see attached vicinity map.
The project will also include the installation of a traffic signal at the intersection of LaBounty Drive and Nordic Way, and the replacement of utility lines in this area. Approaches to the roundabout, as well as the right of way between Nordic Way and the Main/LaBounty intersection, will also be improved.
REQUESTED ACTION(S):
Applicant seeks approval for the construction of a two-lane, give-leg roundabout at the intersection of Main Street and LaBounty Drive, and improvements to approaches to the roundabout, as well as right of way between Nordic Way and Main/LaBounty intersection. Applicant also seeks approval for installation of traffic signal at intersection of LaBounty Drive and Nordic Way.

The lead agency for this proposal has determined that the project does not have a probable adverse impact on the environment, mitigation measures will be covered through the City of Ferndale regulations and review process.
The City has determined that the construction of the proposed roundabout and installation of traffic signal is likely not to result in adverse impacts to the environment provided that the project complies with all City codes in place at the time of building permit application.
In addition to compliance with current City regulations, the following mitigation measures were identified relative to the proposed project:
EARTH:
Temporary and permanent erosion control measures will be utilized during construction and during normal operations.
AIR:
The City will identify detour routes during construction and will also seek to maintain through-traffic in this area during the period of construction, in order to facilitate typical travel as well as preserve business operations of nearby commercial establishments. The City may also consider construction activities during non-peak periods (evenings, weekends).
Following construction, the completed roundabout is anticipated to significantly reduce emissions resulting from idling at stop lights. When this and other transportation improvements are constructed, traffic in all directions is anticipated to be able to move in a more-continuous flow than it does at present.
WATER:
Temporary erosion control measures will be established during construction; permanent treatment and conveyance facilities will be installed as part of this and related projects.
PLANTS:
The City will seek to establish landscaping (which may consist of vegetation, ornamental rocks or hard surfacing, public artwork, etc.) in order to define the space and foster a safe and interface between the pedestrians and motorists. There is a preference for native, drought-resistant vegetation.
LIGHT AND GLARE:
A raised element at the center of the roundabout will reduce/eliminate the glare of approaching traffic. LED lighting may be equipped with shields to prevent or reduce glare.
RECREATION:
The roundabout will be designed to facilitate pedestrian and bicycle mobility to the greatest extent practical.
TRANSPORTATION:
The project is the first of several transportation projects identified by the Main Street Master Plan, the Main Street Planned Action EIS, and the Ferndale Transportation Element as being necessary to serve the growth projected for the area. As these projects (a system of roundabout from the “Walgreens” intersection east to the northbound ramps of Interstate Five) consist of a variety of separate elements, permitting steps, and coordination with other agencies, it is necessary to initiate this first phase now, as the transportation impacts of this phase can be supported by the existing infrastructure at the surrounding intersections.
CULTURAL RESOURCES:
Should archaeological materials (e.g. shell midden, faunal remains, stone tools) or human remains be observed during project activities, all work in the immediate vicinity shall stop, and the area shall be secured. The contractor/owner shall contact the state Office of Archaeology and Historic Preservation (OAHP) at 360-586-3065, the Lummi Nation Tribal Historic Preservation Office (LNTHPO) at 360-384-2298, and the Nooksack Tribe at 360-592-9065 in the order to help assess the situation and determine how to preserve the resource(s). In the event that the find includes human remains the Ferndale Police Department shall be called immediately at 360-384-3390. Regarding human remains, the LNTHPO will contact the appropriate tribal repatriation specialists. Compliance with all applicable laws pertaining to archaeological resources is required.

V.
The Property will be sold to satisfy the expense of sale and the Obligation as provided by statute. The sale will be made without representation or warranty, express or implied regarding title, possession, encumbrances or condition of the Property on December 4, 2015. The default(s) referred to in paragraph III, together with any subsequent payments, late charges, advances costs and fees thereafter due, must be cured by 11/23/15 (11 days before the sale date), to cause a discontinuance of the sale. IX.
Anyone having any objection to the sale on any grounds whatsoever will be afforded an opportunity to be heard as to those objections if they bring a lawsuit to restrain the sale pursuant to RCW 61.24.130.
